By accessing or using the AyEye App (“the App”), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must not use the App.

1.2 Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be posted within theApp and/or communicated via email. Continued use of the App following any modifications constitutes acceptance of the revised Terms.

1.3 Eligibility

Use of the App is limited to users who are at least 18 years old and legally capable of entering into binding agreements. By using the App, you represent and warrant that you meet these eligibility requirements.

1.4 Account Registration

To use the App, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credential sand all activities performed under your account.

1.5 Service Availability

We strive to maintain continuous access to the App; however, we do not guarantee uninterrupted or error-free service. Access may be temporarily suspended for maintenance, updates, or reasons beyond our control.

1.6 Permitted Use

You agree to use the App solely for lawful e-learning, training, and personal or business development purposes. You must not use the App to violate any applicable local, national, orinter national laws or regulations.

User Responsibilities

2.1 Data Accuracy

You are solely responsible for the accuracy and completeness of all information, progress data, profile details, and any other content you input into the App. AyEye is not responsible for inaccuracies in displayed progress, certificates, or related data caused by incorrect user inputs or device issues.

2.2 Account Security

You are responsible for safeguarding your account password and ensuring secure access toy our device. This includes preventing unauthorized access and managing login credentials properly.

2.3 Compliance with Laws

You are responsible for ensuring your use of the App complies with all applicable laws, regulations, and standards relevant to e-learning and digital content access within your jurisdiction.

2.4 Device Compatibility

You are responsible for ensuring that your device meets the App’s technical requirements. We are not liable for technical issues arising from incompatible devices, outdated operating systems, or insufficient storage.

Limitation of Liability

3.1 “As-Is” Service

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. We do not warrant that the App will meet your specific requirements or operate without interruption or errors.

3.2 Indirect Damages

In no event shall AyEye App, FRANCHISE STARTUPS LTD, nor any of its directors, officers, or employees be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or learning progress resulting from your use of theApp.

3.3 Liability Cap

To the maximum extent permitted by law, our aggregate liability for all claims related to theApp shall not exceed the total amount paid by you for the service within the prior twelve (12)months.

3.4 Security and Data Breach Disclaimer

While AyEye App implements reasonable security measures to protect user accounts and data, no digital system is entirely immune to breaches. We disclaim liability for any unauthorized access, data alteration, or loss resulting from cyberattacks, malware, or actions beyond our reasonable control.

Both administrators and users share responsibility for maintaining secure access to their accounts. We shall not be held liable for incidents arising from user negligence, login sharing, or inadequate device security.
